    UMMMMMMM? Says:

how about the fact that he wrote a 4 PAGE FOUR PAGES>>>>> paper to the “victim & her family” expressing his total remorse and embarrassment!! If that doesn’t scream I did it and I’m sorry i dunno what does, PLUS the Judge we speak of may be know for giving “harsh” sentences but he has known Judge Elwood for many MANY MANY years….. so i doubt it was completely unbiased!

    lol Says:

So, you got caught on here lying about what your “real” name is while calling other people out for not using real names? Well done.

Now, on to the issue at hand.

What you are now saying, is bill LIED to the police and said he did it, but now he’s telling the truth when he says he didnt? Does that about sum it up?

    Nell Says:

Jake, I am not using a fake name. I’m using the name that all my friends know me by. It is a nickname, from my full first legal name.
Bill did not confess to the cops. He didn’t.
I have said on here, mutiliple times, that he gave a statement. We do not consider that a confession. To confess is to say something actually happened. Nothing did.

And, yeah, Bill was dumb enough to believe the police when they told him if he made the statement and agreed with them it would all go away.

I don’t know how the hell you know me, because I really don’t think I know you.

    Reader Says:

“_ _ n e l l, kind of funny you calling people out for fake names is it not?

So to be absolutely clear for everyone, Bill confessed to the cops when he was brought in. You didnt want people to know that, did you? Too bad.

You want everyone to believe that bill was dumb enough to believe it would all just go away if he admitted he did it, during the police interview? Get real.

    Nell Says:

At trial against a minor victim, the minor is excused from the courtroom. In such cases, the accused has no right to face the accuser. Every path we tried was cut down by the DA. When our final attempt at a real case was put up against a threat of destroying the reputation of his wife and family, Bill decided to take the hit, and just wait for justice in the end. With the Alford, the chances of prison were slim. In a gamble of win big or lose big, we chose to back out, lose small, and wait for the truth to come out. It will come out. A lie like this will eat a person from the inside out.
Jake, I ask why do you take such an interest in this case? You are too eloquent to be one of his students, your name doesn’t match with any of her family or their love interests?
Is your true joy in life just adding an extra knife into a family’s pain?
If it was a victory for you to see my brother in law go away for months, lose his job and his house, for the victim’s mother to take his job…then, congrats. Be happy. Why sit around and fight with me?

The federal definition of an Alford plea, from about.com is “In the law of the United States, an Alford plea is a plea in criminal court. In this plea, the defendant does not admit the act and asserts innocence, but admits that sufficient evidence exists with which the prosecution could likely convince a judge or jury to find the defendant guilty.”

I couldn’t find the source of your explaination from any Ohio government databases. This isn’t Ohio law, its from a Federal Case of the State of Carolina v. Alford.

What evidence are you speaking of? Can you please let me know about the evidence? Our lawyer wasn’t told of actual evidence of any kind, other than the original statement. Any evidence that exists other than that has been withheld from us.

    Somebody Says:

Don’t be fooled into thinking that an Alford plea is the act of innocent man. An Alford plea is a gift from the prosecution. Do you believe he is any less guilty by saying “I didn’t do it but the evidence will certainly convict me.” That’s all an Alford plea is and it is a joke. If he was worried about the jury, he could have waived his right to a jury in favor of a bench trial. No, he was worried about the evidence. Like any plea deal, he received something in return – some charges were dropped.

Per the legal definition in the state of Ohio:

“An Alford plea is simply a form of a guilty plea, and, as with other guilty pleas, the judge must see there is some factual basis for the plea.”

What factual basis did the judge see on this one?

Oh, and Nell…my real name is “Jake” – happy now?

    Nell Says:

He didn’t plead ‘guilty’. He entered an Alford plea. This plea means that he admits no guilt. We didn’t want to take the gamble in our small town with a jury, knowing that we could possibly lose and he would face 20 years in prison. In taking the plea, 1/2 of charges were dropped, and a treatment center would be recommended.

Btw, “Somebody” – wanna use your real name? I used mine.
