(05/09/08 – Initial BBT Report)

Tracy Hinson, 38, a science teacher at Lake County High School in Tiptonville, Tennessee has been charged with contributing to the unruly behavior of minor.

It is alleged that Hinson had been sexually involved with a 16-year-old male student.

Hinson has a court appearance set for May 14th.

Reportedly Hinson who has been with the school district since 1992 has been suspended without pay.

05/14/08 – Charges Dismissed

In a courtroom packed with Tracy Hinson supporters, the prosecutor told the judge that he wished to dismiss the charge against Hinson “in this court at this time”.

Judge Danny Goodman dismissed the charges without prejudice, meaning the charges can be refiled at a later time.

A sheriff’s office investigator indicated that the case is still under investigation.

Reportedly Hinson remains suspended without pay by the school system until the investigation is concluded.

08/27/08 – No Contest Plea and Sentencing

Tracy Hinson has pleaded no contest to a single charge of aggravated statutory rape.

Hinson was sentenced to two years diversion, which is basically probation and was ordered to have no contact with the victim.

Hinson, against whom charges was dismissed in May appeared in court under a criminal information, as opposed to a grand jury indictment.

Had the case not been resolved with the plea agreement, it is possible that Hinson would have been indicted by a grand jury as the result of the investigation conducted Lake County Sheriff’s Department.

Hinson resigned from the school system in May.

10/15/08 – Hinson Seeks To Withdraw No Contest Plea

The attorney for Tracy Hinson has filed a motion to withdraw her no contest plea to a charge of aggravated statutory rape.

Hinson is seeking to withdraw the plea she entered into in August because a law that went into effect the previous month requires she register as a sex offender in spite of her plea deal which included a provision that she not be required to register as a sex offender.

10/22/08 – Hinson Allowed To Withdraw No Contest Plea

A judge has ruled in favor of a motion by Tracy Hinson to have a no contest plea overturned.

Reportedly Hinson will now apply for pretrial diversion, a form of diversion that will not require her to register as a sexual offender.

06/25/09 – Pretrial Diversion Granted

Tracy Hinson has been granted pretrial diversion.

Hinson was placed on supervised probation for a year, forbidden to contact the victim and ordered to pay $1,212.50 in court costs and a $35 monthly supervision fee.

Hinson is not required to register as a sex offender and if she complies fully with the conditions of pretrial diversion, she may ask the court to expunge her record.

    Junior Soprano II is mistaken about Hinson’s case. She’s been buying time. What a homely looking woman. With all the sexy teenage girls around, why would any boy want to bang a teacher who looks like a member of The Barrow Gang?

    And by the way – it is defendant who entered a plea, then sought to have it withdrawn. If anyone is drawing this out it is her.

    No junior the prosecutor cannot drag the case out.Every defendant has the right to a speedy trial.If the defendant does not wave that right the prosecutor is given a very limited time to bring the case to trial.Furthermore from the cases I have followed on this site if anyone drags things out it is the accused.

    An excellent point made by Peter Rabbit who’s, once again, right on the bunny trail. The prosecution has unlimited funds and can drag a case on and on for months if not years. A defendant, no matter how innocent he/she may be, can never beat the charges. Your reputation is ruined forever. Your personal life is destroyed. And you face financial ruin of which you will never recover.

    Teaching is one of the most hazardous of all professions. Over the past two decades I have seen at least 10 truly outstanding teachers falsely accused. They are never allowed back in the classroom but, instead, are relegated to a menial position such as working in a book depository. That happens because no matter how innocent a teacher may be, he/she will always be followed by a shadow of doubt.
