Thomas Daniel Nuckles, a former teacher at Country Bear Day School, in Roanoke County, Virginia has been sentenced to 15 years in prison following his conviction on a charge of forcible sodomy of a 4-year-old boy.

Nuckles was charged in August, 2006 with forcible sodomy and aggravated sexual battery of a minor.

In April 2006 while riding home from the day school the boy told his mother that Nuckles had performed oral sex on him. The boy’s mother questioned the boy and when they arrived home separated and bagged the clothing the boy had worn that day. She called police the following day. The mother’s actions in preserving evidence would be critical in the case since DNA evidence from the boy’s underwear weighed heavily in linking Nuckles to the alleged crime.

In March 2007, while maintaining that he did not molest the boy, Nuckles confronted with the weight of the evidence against him entered an Alford plea, which means he maintained his innocence but did not wish to risk a trial by jury and was thereafter found guilty of the sodomy charge by Roanoke County Circuit Judge James Swanson.

As part of the plea agreement, the charge of aggravated sexual battery was dropped.

Today, Nuckles, who faced up to life in prison, was sentenced to 40 years, suspended after he serves 15 years in prison.
