Reportedly, Smith has been charged with 2nd-degree rape and possession of obscene material. The obscene material charge owes to Smith allegedly having photos on his cell phone of someone under the age of 17 years old.

The relationship between Smith and the girl is alleged to have been ongoing for several months and they allegedly had sex at Smith’s home. None of the alleged crimes took place at school or during school hours.

Reportedly, Smith came to the attention of police when information about the relationship first surfaced Friday and school officials notified authorities immediately.

If convicted Smith could face up to 20 years in prison.

Reportedly, another teacher at the school, Amanda Alldredge, 31, has been charged for failing to report the alleged sexual relationship between Smith and the alleged victim.

According to a Gadsden Times report:

The student allegedly told Alldredge about earrings that Smith gave her recently for her 16th birthday and asked for her help in covering it up.

06/06/09 – Nicholas Keith Smith Arrested Again

Nicholas Keith Smith has reportedly been arrested again, this time on allegations that he used the popular networking site Facebook to contact potential witnesses and violated conditions of his bond.

Smith was arrested Thursday after prosecutors filed a motion on Tuesday to revoke Smith’s bond after it was determined that Smith contacted other students, who are potential witnesses in the case against him.

A hearing will take place after Smith is returned to Etowah County to determine if Smith should be held in custody until his trial.
