Marshall David Neal, 33, a world history teacher and coach of the forensic team at Garces Memorial High School in Bakersfield, California has been arrested on suspicion of felony oral copulation with a person under 18-years-old.
The alleged victim is a female student at Garces Memorial High School and she reported the alleged crime to authorities.
Reportedly Neal was held on $100,000 bail following his arrest and was expected to be released on bail Sunday evening.
1/04/08 - Neal Officially Charged
Marshall Neal has been officially charged with two felony counts of oral copulation with a person under the age of 18. Police say that the girl and Neal performed oral sex upon each other and that Neal told his 17-year-old victim to lie to police.
If convicted on both counts he faces up to 16 years in prison.
Neal is currently free on $100,000 bail and is set for arraignment on January 17th.
1/16/08 - Cops Have Tape of Call
Reportedly police have a tape of a phone call between the alleged victim and Neal. In that tape Neal allegedly spoke of the sexual relationship and told the student to lie about it. See the referenced Californian report dated 1/15/08 for the details.
1/17/08 - Neal Pleads Not Guilty
Marshall Neal today entered a not guilty plea to two felony counts of oral copulation with a person under the age of 18.
Neal’s next court appearance is set for January 31st.
1/31/08 - No Contest Plea
Marshall David Neal today accepted a plea deal and pleaded no contest.
In exchange for the no contest plea, one of the felony charges of oral sex with a person under 18-years old was dropped.
Neal was immediately taken into custody and will serve one year in county jail with his sentence beginning immediately. He will also serve three years probation and will be required to register as a sex offender.
10/03/08 - Neal Released From Jail Early
According to the Kern County Sheriff’s Department, Marshall Neal was released from jail on Tuesday, about four months short of his 1-year sentence.
Neal will now serve three years of probation and is required to register as a sex offender.

The “man” was blamed because she was a child. As a teacher he was in a position of authority…someone that could be trusted. I know Marshall, I was in high school debate and competed against his teams from Garces. Do I think he is a depraved sexual predator? No. Do I think he was wrong in what he did. Yes most definately. Marshall never stuck me as the type of guy who really had “grown-up” relationships. I never once heard of him dating anyone, no girlfriends, no blind dates…he spent his entire waking life with kids. At school and on the road for Forensics.
Marshall Neal is a nice guy yes, but make no mistake that by engaging in a sexual relationship with a minor student is not to be taken lightly. She trusted him, all of his student did. It is a sad day in America when we can no longer trust those we trust to teach and educate our children. Granted, if you take into account that in most cases of child molestation there is violence or use of fear, and that in this case there seems to be none…the 1yr jail time seems to be a proportionate response. I agree with having to register as a sex offender, and I would hope that his teaching career anywhere in the U.S. is over.

Marshall responded to the sexual advances of the girl. She performed oral on him. He then performed oral on her. The only reason anyone found out is because she used her brother’s phone to check her e-mail. Her brother then used the browser history to snoop in her e-mail and found out that Marshall had been fooling around with the young lady.

I’m reading the blog about this on bakersfield.com and even the girl is coming forward saying this is unfair and that she’s no victim. I think nowadays if you have a penis they stick it to you!

why is it the man is always blamed, Im sure he didn’t hold a gun to her head and force her to let him perform oral sex on her, she obvieously liked it or it wouldn’t have happened a second time
