(06/28/08 – Initial BBT Report)
Marcelito Creer, an elementary teacher for the Bureau of Indian Affairs working at Choosgai School in Tohatchi, New Mexico has been arrested on sex abuse charges after an 8-year-old boy was allegedly improperly touched at a Tohatchi community function.
Creer, who along with the alleged victim and his family migrated to New Mexico from the Philippines has been charged with criminal sexual penetration of a minor, criminal sexual contact of a minor and intimidation of a witness and is being held on $50,000 cash bond.
The alleged victim told his family of the touching but the family was reluctant to contact authorities until local residents encouraged them to do after after a community meeting at which the allegations were revealed.
The alleged crimes are said to have occurred during an overnight party for children within the Tohatchi community on May 25.
In researching Marcelito Creer, we have discovered that the Minutes of the November/December 2004 of the California Commission on Teacher Credentialing suspended the teaching credentials of Marcelito Creer for a period of 180 days for misconduct under Education Code section 44421.
A review of California Education Code section 44421 reveals the following:
The Commission for Teacher Preparation and Licensing shall privately admonish, publicly reprove, revoke or suspend for immoral or unprofessional conduct, or for persistent defiance of, and refusal to obey, the laws regulating the duties of persons serving in the public school system, or for any cause which would have warranted the denial of an application for a credential or the renewal thereof, or for evident unfitness for service.

I still consider Mr. Creer as my close friend, and no matter that this turned out bad for him. I will always consider him my friend and as far as, “do I think he did this?”, “NO”.
I feel that he got a bad deal, and that there were unprofessional conduct in his case, because of a lack of defence and a lack of investigation in this case. No matter how you stack it up and what has been said. I have known Mr. Creer for years, and know how he is, and he cares for kids, and I would allow him to be alone with my children and would have NO worries what so ever!!!!

You have heard the lawyer interviewing the kid? It’s hearsay! Commenting of what is being heard is the lowest remark ever.
The truth is, it was the legal assistant who talked to the child, and it took sometime for the conversation to take place.
Have you seen the video tape when the child was interviewed in ABQ? Of course you did not! Had you seen it and heard it yourself, then you will begin to think otherwise.
Have you wondered how the supposed to be 30 year sentenced was commuted to just three years? and to this time 18 months?
Creer could have done something wrong but the court could not prove that all the allegations (ab initio) are done by Creer in toto.
THE TRUTH IS, WE COULD HAVE GONE TO TRIAL BUT HONESTLY WE DO NOT HAVE THE MONEY TO HIRE A LAWYER. CREER WAS LITERALLY ABANDONED BY HIS COMPANY OF FRIENDS.
CREER WAS NOT TRIED, AND HE WAS NEVER TRIED! If you are familiar with the judicial system, he was only up to the bargaining agreement. and the proposal ranges from 3 yrs, 5yrs and 7yrs imprisonment (whoever gave these suggestions, you better find out). REMEMBER, the other grave charges were dropped long time ago, the only charge left was illegal contact with a minor, (whatever that contact was the court did not find any medical nor physical proof for that.)
SO, CREER WAS LEFT WITHOUT AN OPTION BUT TO SETTLE FOR 3 YEARS. Having served for a year already so he still has two, and for the two he will just serve 85% of it that is 20 months. PLUS, he will not be registered as a CHILD Offender. THE DEAL SEEMS TO BE COOL. Creer grabbed it. BUT HONESTLY, if we had the money, we will really fight to the end. But SAD to say, the money we have is barely enough for the our family.
Truly, this event really made a difference in Creer’s life, in Creer’s family.
As I mentioned elsewhere, he could have done something wrong, BUT, I DO NOT BELIEVE THAT HE DID WHAT HE WAS ACCUSED OF.
One lesson, advocates believe in children no matter what they say.
