Kevin Burns, 24, a former math teacher, basketball and golf coach, at Cardinal McCarrick High School, in South Amboy, New Jersey has pleaded guilty to molesting a 16-year-old female student.

Burns was originally charged with sexual assault and official misconduct, which are second-degree felony charges.

As part of a plea deal, he pleaded guilty to the misconduct charge and criminal sexual contact and will be required to register as a sex offender.

Also as part of the plea deal Burns received a three-year prison term with no period of parole ineligibility and he will be permitted enrollment into an intensive supervision program, a form of strict parole that could free him from prison more quickly.

Burns acknowledged that he molested the student from June 1 to Aug. 31, 2006 while he was a teacher at Cardinal McCarrick High School.

Burns came to the attention of authorities when a family friend of the victim brought their concerns about an inappropriate relationship between Burns and the girl to the attention of school officials who contacted authorities. He was arrested and charged in May of this year.

10/26/07 - Sentencing

Kevin Burns has been sentenced for molesting a 16-year-old female student.

Superior Court Judge Frederick DeVesa sentenced Burns to three years in prison.

The judge then stayed that sentence to permit Burns’ attorney to appeal the judge’s refusal to consider the request of the victim and her father that Burns not receive any prison time. Both the girl and her father maintain that sending Burns to prison will only lead to more pain for the victim.

The judge ruled that Burns would be sentenced in keeping with the terms of his plea agreement which called for the three year sentence.

Reportedly Burns will have to serve about 9 months in prison before becoming eligible for parole. The terms of the plea deal also call for Burns to register as a sex offender under Megan’s Law.
