Kerry Smith Foulk, 47, a former substitute teacher at Nederland High School in Nederland, Texas has pleaded guilty to felony charges of indecency with a child for engaging in sexual contact with a 14-year-old girl in September 2006.

Under the terms of the plea agreement with prosecutors Foulk will serve 10 years deferred adjudication probation and be required to pay restitution for the victim’s counseling.
Faulk will also be required to cease teaching and will be required to register as a sex offender.
The sex abuse was alleged to have occurred in Faulk’s home and after the first victim came forward other girls did likewise with additional allegations which did not rise to the criminal level.
The victim was not in any of the classes that Faulk taught at the school.
Faulk’s deal with prosecutors must receive a judge’s approval.
Formal sentencing is set for next month if the judge approves the plea deal.
12/01/08 - Victim’s Family Files Civil Suit
Reportedly the family of the victim has filed civil suit against Kerry Foulk who they say molested her, causing physical, psychological and emotional damage that exists to this day, according to the lawsuit. The girl’s family says she still receives psychological care and counseling.
The family is seeking damages, court costs and other relief.
