Kay Sorg, a science teacher at Albany Middle School, in Albany, California accused of having sex with a high school girl 16 years ago appeared in court today in an attempt to get the case dropped because it has gone beyond the statute of limitations.

Sorg has not yet entered a plea in the case and likely will not unless Superior Court Judge Sandra Bean rules that the prosecution can meet the elevated level of evidence needed for such an old case. A hearing on that issue is scheduled for November 30.

Elizabeth Grossman, Sorg’s attorney says, “It’s an outrage they have even brought this case. Having reviewed every piece of evidence the prosecution has provided, there is not one shred that supports their case. Here is a fine teacher who has to be dragged through the mud and have her career and reputation jeopardized.”

Sorg, who has been a teacher in the Albany school district for 25 years, posted $150,000 bail in May and was charged with two felony counts of oral copulation of a person under 16 and two counts of sexual penetration of a foreign object. A fifth count of a lewd act upon a child was dropped by prosecutors.

Sorg has been on administrative leave since her arrest.

The relationship between Sorg and the girl allegedly took place during 1990 and 1991. Reportedly the alleged victim contacted the Albany school district about the relationship, and said she was concerned about Sorg working with children.

3/26/08 - Not Guilty Pleas Entered

Kay Sorg accused of having sex with a high school girl in the early 1990s has pleaded not guilty.

The next hearing in the case is scheduled for May 30.

Sorg remains free on bond.

11/21/08 - Sorg Admits Relationship and Charges Dropped

The Alameda County District Attorney’s Office agreed to drop charges against Kay Sorg in exchange for her admission of the relationship as well as her resignation from the Albany Unified School District and an agreement to surrender her teaching credential.

Webmaster’s note: This has to be one of the strangest outcomes of any criminal case of which I am aware.

Since Kay Sorg admitted a sexual relationship with the girl she is morally guilty however since the criminal charges were dropped as a result of her admission of guilt she must be considered legally not guilty.

    Peter Rabbit - Are you so stupid that you don’t know what “statute of limitations” means?

    For someone who runs their mouth so much and PRETENDS to be an educated adult, you sure aren’t very bright.

    The judge may have realized that the 16 year old female student knew what she was doing and played a large part in the relationship and didn’t consider it a crime. Or maybe the judge is very liberal and since it was girl on girl it’s all good.

    As a former student of Kay Sorg (she taught my science classes in middle school), I can honestly say that I am shocked by these allegations. Ms. Sorg wat the kind of teacher that kids could confide in and I seriously doubt that she would have crossed the line. I think that it is a serious problem when teachers take advantage of students, but sometimes the teachers are innocent. In this case, I truly believe she’s innocent.

    Wow, it must be amazing for M to know Kay Sorg that well… To know everything she does in private. Maybe, out of the thousands of teachers acting badly on this website and throughout the country, Kay Sorg is the ONLY one who’s innocent. All those other molesters, who also shocked their communities, whose friends and students couldn’t believe their beloved teacher could be so disappointing… well, certainly they’re different than our precious Kay Sorg, aren’t they?
