(10/19/07 – Initial BBT Report)

Janet Fackovec, 25, a teaching assistant for special needs students at Stall High School, in North Charleston, South Carolina has been arrested on allegations that she had sex with a student and contributed to the delinquency of a minor.

Fackovec was arrested Thursday at the school and school administrators were reportedly unaware of both the allegations against Fackovec and her pending arrest by the North Charleston Police Department.

Fackovec who has worked at Stall High School as a teacher’s aid since September of 2006 has reportedly been suspended with pay pending the outcome of the investigation and criminal case.

Very little information has been released regarding the alleged victim, other than the fact that it is a male teenager and his is reportedly in in the custody of the Department of Social Services and in another part of the state.

Fackovec who has been charged with contributing to the delinquency of a minor is scheduled for a bond hearing today.

Update 10/19/07:

Janet Fackovec has been charged with two counts of contributing to the delinquency of a minor in Charleston County and one count of contributing to the delinquency of a minor in Dorchester County.

Fackovec is not charged with any criminal sexual charges, reportedly owing to the fact that the boy was 16-years-old.

The Charleston County magistrate set Fackovec’s bond at $30,000, and ordered her to stay away from anyone under 18 years of age. Fackovec appeared in North Charleston Municipal Court Thursday night to answer to the Dorchester County charge. No additional info is available on any bond amount there.

04/30/08 – Guilty Plea and Sentencing

Janet Fackovec has plead guilty to two counts of contributing to the delinquency of a minor.

As a result of her guilty plea Fackovec received a six year jail sentence with all but 90 days suspended. She was given credit for time served meaning she will spend a total of 84 days in jail.

    I ran across this case during a genealogy research project, From the rarity of the name, and the area Janet comes from, I have to assume she is distant cousin)

    Putting potential family ties aside, I think that she probably crossed a line, but lets look at motivation before getting out the rope… From what I have read in the media, it seems like she was being empathetic to a kid in a bad situation- a kid only a few years younger than herself. Helping him “run away…” (I would have to see more evidence on that), but from what the media is saying she was trying to help the student out, and unfortunately the boundaries got blurred. If it had not been a teacher/student relationship, it would hardly been a footnote.

    A 90 day sentence for this is more then just- I would have preferred to see time served and probation. The worst punishment is that at 25 she has destroyed her chances at a teaching career (or most any career that requires a background check)- something thing she states she has wanted to do for her whole life, and she will have to live with this mistake for the rest of her life.

    The “victim” is a 17 year old boy- While I am very sensitive to the law and the boundaries that should exist between students and the teachers they are entrusted to, from personal experience I can tell you that having an “inappropriate” relationship at this age with an older woman will probably not negativity impact his life or future potential.

    Before people start taking shots at me- Let me take away the some of the ammunition: I have a child, and if she were to become sexually involved with a teacher I would be very upset- BUT I would apply the same standard that I am proposing here…Age difference, extenuating circumstances, was the power gradient used as coercion… And I was the 17 year old boy, In an situation not unlike this one, and I can tell you from 30 years down the line, my life was not overly harmed by the experience.

    no, she hasn’t been tried.. Her lawyer told her to take the plea because the evidence was overwhelming.. Get your story straight

    I have met this person and I would really find it hard to beleive that any of it happened. Unfortunately, she has already been “tried” and found guilty by society. This is sad, indeed.
    I am a teacher and I am blown away by the ease with which students can cry wolf and a teacher be arrested. There has to be a better way to protect our youth as well as the integrity of good innocent people.

    Ms. Fackovec is unfortunately the victim of a large and kind heart.
    The victim lied often about major events and manipulated often to get attention in very dramatic and broad ways without any view or care of the consequences to others. Its sad that we can’t help a kid anymore without being accused of horrible actions. In Dangerous minds (movie) she takes her kids to eat, makes home visits, etc. No one questioned her motives or that she was having sex with a student. I would hope people wouldn’t question Ms. Fackovec’s motives and pass judgement before a judge or jury does.
    She has a kind and loving heart…which got in the way of her seeing how easy a parent/student can make an accusation that can change your life forever. Sad….
