David James Wagner, aka “Jamie” Wagner, 32, a history teacher and softball coach at Madison Junior/Senior High School in Madison Township, Ohio has been arrested for allegedly “engaging in sexual activity” with a 17-year-old girl.
Wagner has recently been under investigation for an inappropriate relationship with an 18-year-old female student. That investigation led detectives to the 17-year-old girl.
Wagner has been charged with two counts of sexual battery, a third-degree felony.
Police say that Wagner admitted to having a sexual relationship with the girl. It is alleged that Wagner and the alleged victim had two separate sexual encounters in April and May of this year.
Following his arrest Wagner was being held in the Butler County Jail in lieu of $20,080 bond.
Wagner, in his second year with the school and reportedly the president of the teachers union, has been placed on administrative leave.
On Monday evening the Madison Township School Board voted 3-2 not to accept the resignation of David Wagner. At the meeting the father of the alleged victim urged the board members to reject Wagner’s resignation and instead begin termination of his employment.
06/11/08 – David Wagner Fired
By a vote of 4-0 the Madison Township School Board voted to fire David Wagner.
07/24/08 – Guilty Plea
David “Jamie” Wagner has pleaded guilty to one count of sexual battery.
As a result of his guilty plea Wagner faces up to five years in prison, a $10,000 fine or both at sentencing.
Wagner will be classified as a Tier III sexual offender, required to register with the sheriff’s office every 90 days for the rest of his life.
08/28/08 – Sentencing
David Wagner made a tearful appeal for leniency at today’s sentencing hearing saying that his wife and two small children needed him but that appeal fell on deaf ears as the judge sentenced Wagner to 3 years in prison.
Wagner will also be required to register as a sex offender for life.
He has already surrendered his teaching certificate.
At Wagner’s sentencing hearing the victim’s mother spoke directly to Wagner saying, “What you did to our daughter is inexcusable. At her softball games, you could look her Dad and I in the eye. Speak to us. All the while knowing what you were planning on doing. Unconscionable.”

Mark says he wasn’t a pedofile. I disagree. I worked with him long ago and he talked about wanting to have sex with my infant daughter. At the time I thought he was just trying to piss me off, so I ignored him. Turns out he probably would have had sex with my daughter if he could have.
Had I known that he was coaching somewhere, I would have contacted the school board and let them know what he had said. Just in case he would have. Turns out that he did himself in. I feel bad for his kids, but not him or his wife. She had to have known that he was an ass and an idiot before they got married!!
that is my brother you are talking about and i know for fact he would never say that. this is long and gone and you should be over it by now. he is paying his time.

Don’t any of you feel sorry for him but have pity for his wife and children… David “Jamie” is not a class act and if anyone truly knew him back in Thomas More College, he is a cruel and a classless sob when he attended there back in 1995..
yea wagner was a cool guy, he was the defensive coordinator on the varsity football team too. The girl is nasty he would have never done this forcefully or in any other matter. She drove herself over there knowing he had a wife and kids. She knew what he wanted. The mom said he could look her in the eye and talk to her knowing what he was going to do, well its the same for her daughter she did the same thing.In less then a few months it would have been legal, besides the fact he was married. He and the 18 year old girl had been texting, her boyfriend found out and came to the school to tell the principle about it. That would have been nothing maybe he would have had to withdraw from the school. but shortly after that maybe a day, the 17 year old girl went and turned him in at the station.
When you hear the whole story, it is pretty sad. This girl drove herself to his home and then bragged to her friends about what she did. She had made so many comments over the last 3 years about trying to sleep with him.
What an idiot he was to fall for it.
Guru, you are boring me. The woman was 17. Yeah, it was wrong. But as James says, if he was a she the case would have been A LOT different.
So go preach your high morals elsewhere Mr. Almighty.
He confessed to a crime, a serious crime. No excuses, he is a grown man in a position of trust.
If he would have been a woman, he would have received probation!
Um. This guy got nailed to the cross! The “victim” was 17. That’s “seventeen”. S-E-V-E-N-T-E-E-N!!! The guy is NOT a pedophile. She was 17! Okay, all of you who think I am “pro-sex offender” just stop right there. I am not. With all due respect to the “victim”, from this story, it seems that there was no force involved; and that it was consensual. SOOOOO….. She was 17!. Yes, that is illegal. I agree that he should be punished for having sexual relations with a SEVENTEEN year old, because it is illegal…of course. But to sentence him to 3 years in prison? That’s THREE YEARS!!! … T-H-R-E-E Y-E-A-R-S!!!!!
