David Lista, 35, an English and leadership teacher at Mills High School in Millbrae, California has been arrested on allegations that he recorded female students using a restroom adjacent to his classroom.
Lista is accused of mounting a video camera inside a false ceiling in the restroom, using a small hole in a ceiling panel to permit making a video record of those using the restroom.
It is alleged that Lista recorded up to 19 individuals using the restroom over a period of one to two months.
Lista was arrested after a technology coordinator at the school trying to determine why the school server was overloaded stumbled upon images of students using the bathroom. That find prompted a search of Lista’s home during which a small amount of methamphetamine was allegedly found.
Following his arrest, Lista was released on $10,000 bail with his arraignment set for April 8th.
08/28/08 – No Contest Plea
David Lista, in a deal with prosecutors, pleaded no contest today to allegations that he downloaded child pornography from the Internet and videotaped female students using the school bathroom according to a chief deputy district attorney.
Lista pleaded no contest to one felony count of possession of child pornography, one count felony possession of methamphetamine and two counts of misdemeanor improper videotaping.
Sentencing for Lista is set for October 30th and he faces up to two years in state prison.
Lista will be required to register as a sex offender.
10/31/08 – Sentencing Delayed
Sentencing for David List was delayed a month yesterday because a doctor needs more time to assess if he remains a threat to the community.
Lista’s sentencing is now set for November 24th.
11/24/08 – Sentencing
David Lista has been sentenced to two years in state prison.
Lista will be required to register as a sex offender.

Does anybody know what happened to (Name Deleted by site moderator) who also taught at mills high school? After this lists thing happened the police investigated him as well because he alegedly had relations with students. Coincedentally he no longer teaches at mills either.
Does anyone know if it’s a crime to record only the sounds of someone going to the bathroom, not a video recording of the person or the event?
I would be certain that they are not available – the FOIA does not allow for disclosure of identities of victims who are minors.
Professor Pat, Are you sure the videos can be obtained by the public? Aren’t they considered child porn or something along that line? After all, they are video recordings of minor female students taking a crap. I think you are mistaken, but then again it’s in California where anything perverted is acceptable.
Knocknock, you’ll be happy to learn that yes, the videotapes are available to the general public under the Freedom of Information Act. From what I understand though, the girls using this particular bathroom were all going #2, so if watching nubile young ladies wiping poo poo off their butts turns you on, have at it.

Two Years!!! He is a sicko and he faces up to two years!!! I don’t believe that people should be required to register as a sex offender because they shouldn’t be leaving the prison system.
