(02/20/09 – Initial BadBadTeacher.com Report)

Thomas G. Henry, 24, reportedly a para-educator in the video production department at South Kitsap High School in Port Orchard, Washington has been arrested and charged with two counts of first-degree sexual misconduct with a minor for a relationship police say he had with a 17-year-old female student.

Thomas G. Henry

Henry came to the attention of authorities when school officials learned of Henry’s potential relationship with the student on Tuesday after another student reported it to a teacher.

It is alleged that when police questioned Henry about the allegations he admitted to having a sexual relationship with the girl but said it only happened after she dropped out of school.

Police allege that the girl said she and the teacher had only kissed and had agreed not to have sex until she turned 18. However police say that she later admitted that the two had sex at least 30 times between December and January, including while she was still enrolled at the school.

Henry was arrested by the Kitsap County Sheriff’s Office and booked into Kitsap County Jail Thursday night on $200,000 bail.

On Friday Henry was arraigned and his attorney sought a bail reduction to $10,000. The prosecution requested bail be maintained at $200,000. The judge ruled that bail for Henry would be set in the amount of $25,000.

Henry has reportedly been placed on administrative leave by the school system.

His trial is scheduled for April 13th.

10/08/09 – Case Update

Earlier this year, prosecutors re-filed misdemeanor second-degree sexual misconduct charges against Thomas G. Henry, effectively dropping the felony counts.

As a result, Henry and prosecutors struck a deal under which Thomas Henry entered into a diversion agreement with county prosecutors.

Under the terms of that agreement, if Henry remains crime-free for a period of two years, prosecutors will drop all charges.

In making the deal, prosecutors referred to “inconsistencies with the evidence” and said they couldn’t ascertain clearly “what exactly transpired” between the accused and alleged victim.
