Guilty

Grey Nevelos, 56, a physical education teacher and track coach at Estancia High School in Estancia, New Mexico has been charged with four counts of criminal sexual contact with a minor and three counts of contributing to delinquency of a minor.

It is alleged that Nevelos touched two of his female athletes while they were nude and offered them alcohol.

The crimes are alleged to have occurred in 2006 and 2007.

Nevelos came to the attention of authorities when rumors surfaced at the school. The school conducted an initial investigation and then turned the info over to police.

Following his arraignment on Friday Nevelos was released on $50,000 bond and is wearing an ankle surveillance bracelet and prohibited from being in Torrance County except for criminal proceedings.

10/02/08 - Guilty Plea

Today Grey Nevelos pleaded guilty to contributing to the delinquency of a minor.

In exchange for Nevelos guilty plea to the one count, five additional counts were dropped by prosecutors.

Nevelos was ordered to surrender to the Torrance County Sheriff’s office on October 6th for transport to a 60-day diagnostic evaluation prior to sentencing.

Nevelos could face up to 18 months in jail at sentencing.

James Javier Cruz, 29, a former girls soccer and basketball coach at Alamogordo High School in Alamogordo, New Mexico has pleaded guilty to three counts of having sex with a 16-year-old female student-athlete.

It was alleged that Cruz picked the girl up at Alamogordo High School before her fourth period class began and took her to his mother’s apartment where they had sex. Afterward, Cruz allegedly took the girl back to school before her classes ended.

Cruz was arrested in April on five counts of criminal sexual penetration of a minor and three counts of contributing to the delinquency of a minor. The plea deal means that the victim will not be required to testify at trial.

Cruz faces up to four and a half years in prison and fines of up to $15,000 when sentenced, however a sentencing date has not been set.

Pending sentencing Cruz remains free on $40,000 bond.

Marcelito Creer, an elementary teacher for the Bureau of Indian Affairs working at Choosgai School in Tohatchi, New Mexico has been arrested on sex abuse charges after an 8-year-old boy was allegedly improperly touched at a Tohatchi community function.

Creer, who along with the alleged victim and his family migrated to New Mexico from the Philippines has been charged with criminal sexual penetration of a minor, criminal sexual contact of a minor and intimidation of a witness and is being held on $50,000 cash bond.

The alleged victim told his family of the touching but the family was reluctant to contact authorities until local residents encouraged them to do after after a community meeting at which the allegations were revealed.

The alleged crimes are said to have occurred during an overnight party for children within the Tohatchi community on May 25.

In researching Marcelito Creer, we have discovered that the Minutes of the November/December 2004 of the California Commission on Teacher Credentialing suspended the teaching credentials of Marcelito Creer for a period of 180 days for misconduct under Education Code section 44421.

A review of California Education Code section 44421 reveals the following:

The Commission for Teacher Preparation and Licensing shall privately admonish, publicly reprove, revoke or suspend for immoral or unprofessional conduct, or for persistent defiance of, and refusal to obey, the laws regulating the duties of persons serving in the public school system, or for any cause which would have warranted the denial of an application for a credential or the renewal thereof, or for evident unfitness for service.

Dominic Ebert, 38, a former fifth and sixth-grade teacher at Sunland Park Elementary School in Sunland Park, New Mexico has accepted a plea deal under which he pleaded guilty to a fourth-degree felony charge of child solicitation by computer.

As part of the plea deal prosecutors dropped a second solicitation count.

Ebert came to the attention of authorities when a concerned resident in California contacted the Attorney General’s-New Mexico State Police Online Predator Unit.

Working in cooperation with the State Police Online Predator Unit, Agent Carrie McPherson posed as a 12-year old girl having an online conversation with Ebert.

In those on-line exchanges Ebert asked what he thought was a 12-year-old girl to perform a sex act. He also allegedly agreed to meet the girl in Las Cruces.

According to the Attorney General’s press release, Ebert apparently was online with the agent during class.

The computer used in the communications between Ebert and the agent posing as the 12-year-old was found by investigators in Ebert’s classroom.

Ebert faces up to 18 months in prison at sentencing.

Duriel Martin, 29, a former junior varsity boys basketball coach at Alamogordo High School in Alamogordo, New Mexico has pleaded no contest to one count of fourth degree felony criminal sexual contact of a minor.

Martin was arrested in September 2006 and was indicted by a grand jury the following month on two counts of fourth degree felony criminal sexual contact of a minor.

It was alleged that Martin in a “highly intoxicated state” entered the victim’s home through an unlocked window and forcibly touched the then 17-year-old female victim in a sexual manner.

Sentencing for Martin will be held at a later date. He faces up to 18 months in prison, a fine of $5,000 and the possibility of being required to register as a sex offender.

10/16/07 - Sentencing

Duriel Martin has been sentenced in the wake of his no contest plea to one count of fourth degree felony criminal sexual contact of a minor.

Martin who faced up to faced 18 months in state prison was instead sentenced to one year and will be required to register as a sex offender.

Martin was originally charged with two counts of criminal sexual contact for events occurring July and September. However the DA’s office dropped one of the counts.
