(01/09/09 – Initial BadBadTeacher.com Report)

Melissa B. Gray, 29, a former teacher at Little Flower Catholic School in Mobile, Alabama has been arrested on allegations that she traded child pornography with a Florida man and tried to arrange sexual encounters for him with two children, one of them a family member.

Melissa B. Gray

Allegedly Gray’s arrest Gray pre-empted plans for her and Milton resident Jonathan Daniel Bervig to have sex this weekend with one of the children, the male family member’s friend, an 8-year-old girl.

An affidavit filed by an Alabama Bureau of Investigation agent indicates that Gray met Bervig in an online chat room and discussed sexual fantasies involving children.

It is alleged that Bervig had visited Gray’s house several times, including an initial visit in which the two had sex. It is further alleged that about a month ago Gray tried to set up a sexual liaison with Bervig, a 7-year-old family member and a female friend of the child.

It is also alleged that Gray gave Benadryl to the two children at her house, then told Bervig to come so that they could “play” with the children. Reportedly Bervig drove to Gray’s house, but left because the children were still awake. He told authorities that Gray was angry that the children had not fallen asleep. Subsequently it is alleged that Gray and Bervig discussed drugging the child with Percocet for the alleged plans for the upcoming weekend.

Gray and Bervig face child pornography charges. Gray is being held in the Mobile County Metro Jail until a federal magistrate judge will decide whether to grant her pre-trial release.

Bervig, who was arrested Tuesday and an investigator from Florida assumed Bervig’s identity online and contacted Gray. She told him during the instant messaging chat that she wanted Bervig to come to her house. Alabama authorities, following Bervig’s statements, obtained a search warrant for Gray’s home on Tuesday. She initially said she had not had any chats about engaging in sex with children, according to the affidavit, but then admitted that she had after officers confronted her with chat logs.

02/03/09 – Grand Jury Indictment

Melissa B. Gray has been indicated by a federal grand jury on charges of possession and distribution of child pornography.

The indictment makes no mention of allegations of Gray drugging two young children in her house so a man from Florida could molest them.

If convicted Gray would face a sentencing range from 5 to 20 years in prison.

08/20/09 – Melissa Gray To Stand Trial

A federal judge says Melissa B. Gray is mentally fit to stand trial on allegations of drugging two children and offering them to a Florida man for sex.

Gray’s lawyer says Gray has been diagnosed with a “chronic mental disorder”and has asked for further psychological evaluation.

09/17/09 – Melissa Gray Reportedly To Enter “Blind Plea”

According to a report published on al.com:

Melissa B. Gray will enter a so-called “blind plea” to possession and distribution of child pornography charges, meaning that she will get no promise of a lenient sentencing recommendation from federal prosecutors in Mobile. U.S. Magistrate Judge Katherine “Kit” Nelson scheduled a Sept. 23 change of plea hearing.

If Gray does follow through with the plea, she will face a sentencing range of between 5 and 12 1/2 years in federal prison.

Defense attorney Neil Hanley said he plans to present testimony about a psychological disorder that Gray suffers.

Julie Amero, 40, of Windham, Connecticut and a former substitute seventh grade teacher at Kelly Middle School, in Norwich was looking at up to 40 years in prison.

She won a victory of sorts today when at her formal sentencing her conviction was tossed out.

Julie Amero

At the sentencing hearing the defense made a motion for a new trial and prosecutors did not object. This owing to the fact that AFTER Amero’s trial was concluded and she was found guilty on four counts of risk of injury to a minor, or impairing the morals of a child the state FINALLY sent the classroom computer at the center of the charges against Amero into a state lab for testing.

The computer was sent to a state laboratory after the trial, and the judge said Wednesday that those findings may contradict evidence presented by the state computer expert.

“The jury may have relied, at least in part, on that faulty information,” said Judge Hillary B. Strackbein, who granted the request for a new trial.

All along Amero who pleaded not guilty to the charges has denied clicking on pornographic Web sites that appeared on her classroom’s computer screen in October 2004 exposing seventh graders to hard-core porn.

Amero’s attorney commended prosecutors saying they acted responsibly in not opposing the motion for a new trial.

No date has been set for the new trial and there is a possibility there will be none owing to the new evidence and a groundswell of support from technology experts who believe spyware and adware programs might have generated the pop-up ads for pornographic Web sites.

07/21/08 – Charges Still Pending

Thirteen months after a judge threw out a jury’s verdict against former substitute teacher Julie Amero, supporters of the accused woman have turned up the heat on Connecticut prosecutors to drop all charges.

Opinion of the Webmaster

I was shocked and dismayed to read that prosecutors are still holding the possibility of another trial over the head of this poor woman, who has been through so much already.

Granted prosecutors do not like to admit that the prosecution of any individual was a mistake, but the weight of collected evidence proves to anyone with an open mind and a bit of common sense that Julie Amero is not only not guilty but in fact innocent beyond any doubt.

That this case demonstrates a gross miscarriage of justice in the extreme is without doubt and gives rise to consideration of the possibility of a malicious prosecution and the civil rights issues that entails.

It is well beyond time that prosecutors sucked up their guts, summoned up their courage and admit that they made a mistake and drop all charges against Julie Amero.

To do otherwise is an extreme insult to the very justice they claim to uphold.

11/22/08 – Guilty Plea to Misdemeanor Disorderly Conduct

After four long years, the Julie Amero case has come to a conclusion with a plea deal with Amero pleading guilty to a misdemeanor disorderly conduct count, giving up her teaching certificate and paying a $100 fine.

Opinion of the Webmaster

Who can blame Julie Amero for wanting this horror story over once and for all.

Shortly after entering her plea Amero said, “Oh honey, it’s over. I feel wonderful” and that is certainly understandable considering what Julie Amero has gone through.

Seldom does the criminal justice system demonstrate such an utter failure to achieving justice as occurred in this case.

In light of this fiasco I am led to the opinion that the Norwich Police Department, the New London County State’s Attorney’s office and its so called “expert witness” are a disgrace to competent law enforcement officers everywhere and as such should not be entrusted with investigating parking infractions, let alone criminal matters that could send a person to prison for 40 years or more.

Hopefully Julie Amero will find peace and happiness this holiday season.

And hopefully the bozos that tried to put her in prison will find a new line of work, for the sad truth is that they are miserable failures in the criminal justice system.

(10/25/07 – Initial BBT Report)

Jennifer Jacobi, 35, of Greenville, Indiana, a former substitute teacher for the New Albany-Floyd County Consolidated Schools has been sentenced to 76 years in prison, with 10 years suspended, on child-molesting charges and still faces sentencing on federal child pornography charges.

Jacobi did substitute teaching at Galena and Mt. Tabor elementary schools, Highland Hills Middle School and New Albany High School.

In pleading guilty to counts of child molesting and conspiracy to commit child molesting Jacobi admitted that she molested a girl twice during a two-year period starting in 2004, when the victim was 8-years-old.

As a result of the plea deal 13 counts of child exploitation were dismissed.

In addition to molesting the child, Jacobi also made arrangements by computer for Richard D. Prado, of Brownville, Maine, to molest the girl. Prado killed himself while in a Maine jail as he was being investigated there.

The 10 federal counts of producing child pornography and one count of possessing child pornography involved children under age 12.

Jacobi has a plea deal with federal prosecutors under which she will plead guilty to two counts of producing child pornography and Assistant U.S. Attorney Gayle Helart will recommend a 35-year prison term that would run concurrent with Jacobi’s state sentence. The federal plea deal must receive a judge’s approval before taking effect.

11/10/07 – Guilty Plea Accepted

U.S. District Judge John D. Tinder accepted Jacobi’s guilty plea in court Thursday and set a sentencing date for December 20. According to Jacobi’s attorney if the judge accepts the 35 year concurrent sentence contained in the plea deal it will give Jacobi the possibility of getting out of prison before she dies.

12/26/07 – Sentencing

On December 20th U.S. District Judge John Daniel Tinder accepted the plea deal arrangement regarding sentencing and formally sentenced Jacobi to 35 years in the federal prison. With “good time”, Jacobi might be eligible for parole in 30 years.
