Herbert “Herb” Allen, 64, a custodian at the Model Creek School, in Peeples Valley, Arizona, has been arrested on a charge of aggravated assault with sexual motivation involving a 13-year-old female student.

It is alleged that Allen asked the girl to meet him in a back room to talk. She complied and once inside the room with Allen, he gave her a hug and kissed her on the lips for several seconds. The incident made the victim feel very uncomfortable and she eventually told her mother who called police.

During the course of the investigation police say they discovered that Allen had given the victim “special” hugs in the past, would hold her hands, and look her over when they were in the same area of the school. It was further discovered that Allen had signed the victim’s yearbook with a nickname he coined just for her. The letters, “YSFL” were used and defined as “Young, Sexy, Foxy, Lady.”

Jeremy Ross Calvert, 21, a former volunteer band teacher’s aid at Higley High School in Higley, Arizona has been sentenced to two years in prison, lifetime probation and is required to register as a sex offender.

Last month Calvert entered into a deal with prosecutors and pleaded guilty to two counts of sexual conduct with a minor. As part of the plea deal prosecutors dropped seven additional counts of the same charge.

Calvert was originally indicted by a grand jury on nine counts of sexual conduct with a minor on allegations that he had sex with a female student in a music practice room in November 2006.

Calvert is being given credit for the estimated 530 days he’s already spent behind bars since his arrest meaning his two year prison sentence is nearly over.

Prosecutors are pursuing restitution for the girl and her family.

Victor Scott McPeak Jr., a fifth-grade teacher at Arizona Charter Academy in Surprise, Arizona has been arrested by federal agents on allegations that he has been receiving and distributing child pornography for years.

McPeak Jr. came to the attention of authorities when the FBI received notice from Europol agents regarding an investigation of people allegedly producing, trading, and possessing child pornography. It is alleged that McPeak Jr. purchased a video called “Daphne With Daddy” from a website operated by an Italian National.

It is further alleged that McPeak Jr. later distributed a video depicting a nude, prepubescent female.

Court document indicate that McPeak Jr. allegedly told investigators that he has a sexual interest in females between 8 and 12 years old and that he is trying to conceal this interest from his 12-year-old daughter.

Two students at the Arizona Charter Academy have accused McPeak Jr. of physical and possibly sexual contact.

06/11/08 - Case Updates

Victor McPeak Jr. has been arraigned and entered not guilty pleas in three cases, two state and one federal. He faces a total of 13 criminal counts in the three cases.

McPeak has a court date set for July 21st in one of the two state cases and a court date set for August 12th in the federal case where he faces one count of possession of child pornography.

Stephen Hume, a former art teacher at Thatcher High School in Thatcher, Arizona has pleaded guilty to six counts of attempted voyeurism.

Hume was originally charged with 14 counts of voyeurism and surreptitious photography on allegations that he video-recorded his students as they changed clothes for art projects.

As part of the plea deal Hume pleaded guilty to a single count of attempted voyeurism, one for each alleged victim.

Sentencing is set for May 5th and punishment may range from probation to 6 years in prison.

05/10/08 - Sentencing

Stephen Hume has been sentenced to one year in jail, three years of intensive probation and he will be required to register as a sex offender.

Upon completion of his probation, his probation officer may recommend Hume be removed from the sex offender registration.

Jennifer Diane Mally, a 26-year-old Paradise Valley High School English teacher and cheerleader coach, has been busted in Maricopa County, Arizona and is facing numerous counts of sexual conduct with a minor.

Mally is accused of having sex with a 16-year-old male student and indications are that the sexual relationship may have been ongoing since October 2006.

The alleged sexual relationship came to attention of authorities when the parents of the alleged victim contacted the school with their concerns and school officials notified police.

Mally was arrested at the school’s administrative offices and immediately placed on administrative leave.

5/18/07 - Jennifer Mally Charged

Jennifer Mally has been officially charged with 17 counts of sexual conduct with a minor, for having sex with a 16-year-old boy.

Mally has hired former U.S. Attorney for Arizona Mel McDonald and will plead not guilty at her arraignment on Monday morning.

Maricopa County Attorney Andrew Thomas in announcing the indictments stated that Mally persistently engaged a 16-year-old male student in sexual misconduct at various locations, including his home and her home over a seven-month period.

Additionally, Thomas indicated that three of the counts allege that Mally had sex with the boy in her Nissan Xterra on the day it was purchased.

5/21/07 - Jennifer Mally Arraigned

Jennifer Mally entered a not guilty plea earlier today to charges involving a sexual relationship with a 16-year-old student.

Mally, who remains free on $18,000 bond was as ordered to appear back in court on July 12 at 8:15 a.m. She is also required to wear an electronic monitoring device, remain at home under house arrest and to have no contact with the victim or anyone under the age of 18.

5/28/07 - Another Boy?

Shortly after Jennifer Mally was arrested for sex with a 16-year-old student, another student spoke with police, an 18 year old saying he too had sex with Mally, twice.

According to police reports the 18 year old indicated:

he tried to talk to Mally about “girlfriend problems,” but she “got upset” and told him it was socially unacceptable to talk to a teacher about that.

Then, he said, a couple of months later he was at her place when her husband was out of town and they had sex twice.

Police indicate that if the second boy and Mally had sex and he was 18 at the time, she would not face additional criminal charges.

6/08/08 - Secret Tapes

Jennifer Mally facing numerous sex related charges for an affair with a 16-year-old male student saw her fortunes take a turn for the worse as the Phoenix Police Department releases tapes secretly recorded of Mally and the victim discussing intimate details of their relationship.

The audio tapes, secretly recorded with the victims cooperation and allegedly containing Mally’s voice, included the following exchanges:

Woman: What did they want to know?
Boy: If we had sexual relations.

Woman: What do you say?
Boy: I said no.

Boy: We had sex a lot. We should not have gone further.

Woman: You’re 16, (his name), if they find out, I’m going to f***ing jail.

Woman: All you need to do is tell your parents this is all crazy and that it’s done.

Boy: You want me to lie to my parents?

Along with two audio tapes, a videotaped interview with Mally was also released. In that interview, Mally confessed to nothing. When detectives left the room, she called her husband. It seemed evident she didn’t realize the conversation was being taped.

“I know what I’m doing,” she says, “I watch CSI.”

7/16/07 - Trail Date Set

Jennifer Mally has been set for trial on October 16th.

The trial date was set in a pretrial conference held last week.

Mally’s next scheduled court appearance will be another pretrial conference next month.

Mally remains free on $18,000 bond.

10/05/07 - Trial Delayed

The trial of Jennifer Mally has been postponed.

The trial which was scheduled for October 16th has been delayed until April 2008. Media reports quote Mally’s attorney as saying the delay is owing to “an overloaded prosecution schedule”

Mally will continue on the same release conditions, including a curfew and restrictions on being around underage teens.

12/04/07 - House Arrest Conditions Eased

A Maricopa County Superior Court judge has loosened the release conditions for Jennifer Mally.

The changes include:

Mally is now permitted to stay out until 10 p.m. on weekends although her Sunday-through-Thursday curfew remains 7 p.m.

Mally may attend religious services on Sundays.

She may go to a shopping mall, movie theater or other entertainment location where youths may be present, as long as she is accompanied by a responsible adult.

Although her conditions were eased somewhat Mally still may not attend any social or high school function where youths younger than 18 may be present.

Mally’s trial is still scheduled to begin on April 2.

3/14/08 - Guilty Plea

Today Jennifer Mally pleaded guilty to three counts of sexual conduct with a minor.

As part of the plea agreement, 14 additional charges against Mally were dropped. Also as part of the plea agreement Mally is required to give up her teaching license and to register as a sex offender.

Sentencing is set for May 9th and Mally faces from one year in jail to six years in prison and a lifetime of probation.

05/09/08 - Sentencing

Today Jennifer Mally was sentenced to 6 months in jail.

Prosecutors were seeking a 5 year prison sentence, however the judge said that 6 months was appropriate owing to Mally’s guilty plea and her show of remorse for her actions.

Mally received a show of support from family members and several students who wore “Team Mally” t-shirts at her sentencing hearing.

Following the sentencing, Mally was immediately taken into custody to begin serving her sentence.
