(2/08/08 - Initial BBT Report)
Carl Troy Kubicek, 35, a math teacher and football coach at Pitman High School in Turlock, California along with Turlock Police Officer Jorge Cruz have been arrested, accused of having inappropriate sexual contact with a 17-year-old girl.
Reportedly the two men do not know each other and their alleged victimizations of the girl do not overlap.
Kubicek is accused on multiple counts of unlawful sexual intercourse with a juvenile and multiple counts of oral copulation with the alleged incidents spanning several months.
Officer Cruz is charged with rape, sodomy and kidnapping while under the color of authority. The alleged victim trained in the Turlock Police Department’s Explorer program.
Reportedly the alleged victim is a student at Pitman High School and she became involved with Kubicek a few months after allegedly being raped by Cruz.
Both men came to the attention of authorities when the girl’s mother went to police after noticing changes in her daughter’s behavior. During the course of investigating Kubicek, the allegations against Cruz arose.
2/10/08 - Released on Bail
Carl Kubicek has been released from jail on $20,000 bail.
2/29/08 - Formal Complaint
On Thursday the prosecutors officer filed a criminal complaint against Carl Kubicek charging him with five felonies and one misdemeanor.
Four of the felony charges allege unlawful sexual intercourse with the 17-year-old female student. The remaining felony alleges oral copulation with a person under 18. The misdemeanor, exploitation of a minor, suggests that the teacher took inappropriate photos of the student.
The alleged crimes are said to have taken place on the Turlock campus and in the 17-year-old’s home.
3/10/08 - Arraignment
Today Carl Kubicek was arraigned on four counts of unlawful sexual intercourse with a 17-year-old female victim, one count of oral copulation and one count of exploitation of a minor.
Kubicek’s arraignment was continued until 1:30 p.m. on April 7th.
04/08/08 - Arraignment Continued
Carl Kubicek pleaded not guilty Monday in Stanislaus County Superior Court as his arraignment was continued from last month.
Kubicek remains free on bond.
07/22/08 - No Contest Plea
Carl Kubicek has pleaded no contest and has been found guilty on two counts of unlawful sexual intercourse.
In return for his plea, prosecutors dropped one count of oral copulation with a minor and two additional counts of unlawful sexual intercourse.
Reportedly the intercourse took place in the 17-year-old student’s home and in a Pitman High classroom.
Sentencing is set for August 21st and reportedly Kubicek’s attorney will argue that Kubicek be given probation.
08/22/08 - Sentencing Delayed
Sentencing for Carl Kubicek, scheduled for yesterday, has been postponed for two months when Stanislaus County Superior Court Judge John G. Whiteside is back from medical leave.
By law, Kubicek has the right to be sentenced by the judge that accepted his plea and he exercised that right.
Sentencing is now set for October 16th.
10/16/08 - Sentencing
This morning, Carl Kubicek was sentenced to seven months in county jail.
The victim testified on Kubicek’s behalf at Thursday’s hearing, saying she didn’t want Kubicek to go to jail. When the judge asked her why she felt that way, the victim replied “It was a consensual relationship and I’m not harmed by it.”
The judge ordered Kubicek to report to the county jail on December 16th to begin serving his sentence.
11/17/08 - Carl Kubicek Jailed
Carl Kubicek, sentenced last month to seven months in jail and with a December 16th date to begin his sentence, has been jailed for allegedly violating a judge’s order to stay away from the victim.
County probation officers arrested Kubicek after Modesto police responding to a suspicious vehicle call near a park allegedly found Kubicek and the now 18-year-old girl together in a vehicle Sunday night.
11/19/08 - Kubicek Wants No Contact Order Lifted
Carl Kubicek made a court appearance today and his attorney indicated that he wants to reverse an order that requires Kubicek to stay away from the teenage girl with whom he’d had sex.
The attempt to have the ’stay away’ order lifted will take place during a December 8th hearing.
12/08/08 - No Contact Order Lifted
Carl Kubicek can legally contact the adult woman he’d had sex with as an underage student, but a judge added an extra two months to his jail sentence today for violating an order that he stay away from his victim.
12/17/08 - Kubicek Rejected For Home Detention
The Stanislaus County Sheriff’s Department has said that Carl Kubicek will not be permitted to serve his sentence on home detention with electronic monitoring.
Kubicek began his 9 month sentence Tuesday at the Stanislaus County Public Safety Center in Modesto.
Kubicek will be required to serve at least two-thirds of his sentence. Reportedly he may apply for an an alterative work program that allows inmates to live at home and do community service for the final three months of a sentence.
Last week Kubicek’s California teaching credential was revoked.

He was one of my teachers too. I did not like him one bit. He was very rude and sarcastic. I knew there was something up with him. He deserves this. He is a nasty disgusting pig for having sex in a classroom. What a waste of human life. Also, he couldn’t teach worth of crap either. I didn’t learn anything from him, I had to read the book on my own and learn myself. Have fun in jail kubicek. Hope it was worth it. Oh and…”don’t be stupid” LOL…idiot…..

I am honestly not surprised what so ever. me and all my classmates saw it coming. he was always flirting with some girl. i had a friend that was in Turlock as an exchanged student from germany. she had told everyone including Mr. (Name Deleted by site moderator) that kubichek had said something sexual to her. he was a very disturbed man. he deserves to go to jail.

I’m a former student of his as well. I thought he was a (Deleted by site moderator). One of my least favorite teachers. He is truly disgusting for having sex with a student in the classroom. What an idiot.

I was a former student of this guy for 2 years in a row. The funny thing is that the #1 rule in his syllabus was “Don’t be stupid!” When he was my teacher I had a lot of respect for him and felt really bad when this story came to light and put most of the blame on the girl. But after him going against the judges orders and making contact with that girl again is just unbelievable. He had a wife, kids, and taught a class at Stan State and threw it all away on that girl. I am even more disgusted that this girl is trying to become a police officer because i am trying to become a police officer myself and last time I checked a police officer is suppose to know the difference between right and wrong and she knows “dating” a 35 year old man with a family is wrong. Those two have given the city of Turlock and the great school Pitman high a horrible name. She’s just after a desperate middle aged man because no one at my high school would touch her. I am so mad at both of them. They make me sick.

Honestly, I had him as a teacher and the guy was pretty flirty with the girls. And the fact that they had sex in the classroom I learn in sickens me. And if he’s “in love” like Peter Rabbit says then he would have done the right thing and waited. And Peter Rabbit, how can you say its not a big deal, its an extremely big deal. IT ISNT RIGHT. But anyways, he broke the law. And to be honest what kind of man is he, to do that to his children and wife.. his kids have to grow up with that last name. Its shameful and selfish of him. He deserves to go to prison. And his “girlfriend” should have some respect herself, HE HAD A WIFE AND CHILDREN. Kubicek and her both have some growing up to do. Its an embarrassment. A true true embarrassment.

Whether or not we agree with the law or not, I can’t forgive someone who clearly understood the law and willfully broke it. It’s just stupid. Judges hate it when you break their little protective orders…they take that as serious disrespect.

The “big deal” is that no-contact order the judge issued at sentencing.
Maybe Mr. Kubicek should have permitted another judge to sentence him instead of availing himself of his right to be sentenced by the same judge that received his plea. It is possible another judge would have “gone easier” on him or maybe even offered to perform a marriage ceremony for the happy couple.
But just about any judge gets very unhappy when a person subject to a no-contact order violates it and odds are Mr. Kubicek just might collect a few more days or maybe even months to go with the seven month sentence he already received.
I guess we will just have to see how it turns out…
