Autumn Faulkner, 26, a 7th grade social studies teacher at Elkins Middle School in Elkins, West Virginia has been arrested on allegations that she had sex with a 15-year-old boy, who is a former student of Faulkner.

Faulkner came to the attention of authorities and was arrested Wednesday after an anonymous tip to the state Department of Health and Human Resources.
Faulkner was initially charged with sexual abuse by a guardian and was arraigned on Thursday. Reportedly she is being held in the Tygart Valley Regional Jail in lieu of $50,000 bail.
Investigators say that the investigation is ongoing and more charges could be filed.
If convicted Faulkner could spend from 10 to 20 years in prison.
04/07/09 – Case Update
Autumn Faulkner appeared in court on Monday and waived her right to a preliminary hearing.
Faulkner’s case will now be turned over to Circuit Court.
Faulkner remains free on $50,000.

Weak allegations of possible conflitc of interests. Randolph County Prosecuting Attorney Richard Busch has decided against recusing himself from the case:
“In an effort to quash any perception of partiality, Busch told The Inter-Mountain Tuesday he would remain on case based on a recommendation from the West Virginia Prosecuting Attorney’s Institute. Busch explained Faulkner is his older sister’s ex-husband’s stepsister”.
Philip W. Morrison, executive director of the Prosecuting Attorney’s Institute, responded to Busch’s inquiry by e-mail stating, “I see no personal interest in the outcome and hence no conflict.”
