Amy Lee Kelly, 41, of Benicia, California and a former teacher at Bacich Elementary School, in Kentfield, California has been charged with two counts of lewd acts upon a child and one count of unlawful sexual intercourse.
Kelly allegedly had sex with two 15-year-old Redwood High School boys during a drunken encounter in Corte Madera in October 2006.
It is alleged that Kelly while visiting a friend became intoxicated, that the two boys who had consumed alcohol arrived at the home of Kelly’s friend to visit the friend’s daughter and that subsequently the daughter caught Kelly in the daughter’s bed with first one and later the second boy and that each time Kelly was involved in sexual activities with the boys.
Allegedly the girl took photographs of Kelly while she was naked and in the presence of one of the boys.
When the boys were later interviewed by police the first boy told them that he and a woman had fondled each other. The second boy told police that the woman asked him upstairs, performed oral sex on him and then had intercourse with him.
Reportedly the first boy when viewing a photo lineup which included Kelly and similar appearing women said he was 90 percent certain that Kelly was the woman he’d had sexual contact with and the second boy shown the same photo line up reported a 50 percent certainty that the woman was Kelly.
Kelly has pleaded not guilty to the charges, has been released on bail and is due back in court on September 6th.
Update 9/07/07:
Michael Semansky, attorney for Amy Lee Kelly, says his client “might have been the victim of a sexual assault by the boys”, rather than her sexually assaulting the two male teens.
Semansky made the comments Thursday after a court appearance to set a date for Kelly’s preliminary hearing.
04/23/08 - Guilty Plea
Amy Lee Kelly in a deal with prosecutors today pleaded guilty to one felony count of oral copulation of a person under 18 years old and one misdemeanor count of battery.
Kelly was scheduled for a preliminary hearing today, however her lawyer announced that a plea deal had been made.
Kelly faces up to three years in prison when she is sentenced on June 11th.
06/11/08 - Sentencing
Amy Lee Kelly has been sentenced to nine months in county jail.
In addition to her jail time, Kelly will be on supervised probation for five years and must perform community service.
Kelly is also barred from consuming alcohol or drugs during her probation and cannot visit with any minors except her own children.
The judge also ordered Kelly to be examined for sexually transmitted diseases and report any positive results to the parents of the teens.
