(11/16/07 - Initial BBT Report)
Allan Eve, 58, a former music teacher at Richland High School in Richland, Washington has been arrested for allegedly having sex with a student over a six month period and making inappropriate advances on two other female students.
Eve who resigned from the school two weeks ago as the investigation got underway is charged in Benton County Superior Court with first-degree sexual misconduct with a minor, communication with a minor for immoral purposes and fourth-degree assault with sexual motivation.
It is alleged that Eve slipped notes of a sexual nature into one of the girl’s locker after which Eve and the student then had sex one to two times a week in the school’s band supply room.
It is also alleged that Eve sent suggestive notes to another female student.
It is also alleged that he made a third student feel uncomfortable by touching her and telling the girl how lucky her boyfriend was.
11/21/07 - Eve Pleads Innocent
Allan Eve appeared today in Benton County Superior Court in Kennewick and pleaded innocent to charges of first-degree sexual misconduct with a minor, communication with a minor for immoral purposes and fourth-degree assault with sexual motivation.
Eve remains out of jail on bond.
05/08/08 - Defense Motion to Dismiss
The attorney for Allen Eve is trying to get the charges dismissed.
He contends that Eve and the 18-year-old girl were two consenting adults engaging in nothing more than intergenerational sexual intimacy.
The prosecution contends that the statute under which Eve was charged is rationally related to a legitimate government interest.
A judge set a hearing on the matter for July 8th. Eve’s trial is set to start 6 days later.
07/15/08 - Judge To Consider Dismissal of Charges
Today a Benton County judge listed as defense attorney Jim Egan and Deputy Prosecutor Adrienne Farabee presented their respective positions on Egan’s efforts to have charges against Allan Eve dismissed.
The defense maintains that charging his client for having consensual sexual relations with another adult violated their right to privacy.
The prosecution maintains that the law is presumed constitutional and needs to be analyzed as it was applied in this case.
The judge is considering whether to grant the motion for dismissal.
Eve’s trial is currently set for October 13th.
08/15/08 - Judge To Toss Out One Charge
One of the three counts against Eve for alleged inappropriate contact with female students will be dismissed as the judge rules that it was not a crime for a teacher to have sex with an 18-year-old student.
The judge said that the law is too vague.
The prosecution indicated it planned to speak with the alleged victim and her family before deciding if it would appeal the judge’s ruling.

This from a man who segregated the H.S. band members on the bus for band trips in Montana in the 1980’s. Girls in front (frosh in front, then soph, juniors, and seniors), chaperones in middle, and boys in back (frosh in the first ‘boy’ rows, soph, jr, sr). I never saw anything odd with him and students during my days, but rumors about a relationship with another teacher did surface. What was he thinking?

He did send letters to students, I know this for a fact, because I was one of the girls that received them. I graduated almost two years ago from RHS, and I know alot of students looked up to him. I feel sorry for his wife. Hopefully an end to all of this will come soon.

I am still shocked. This man was the best teacher I’ve ever had, and most of my high school memories revolve around the music program. He came to my wedding. Groups of us spent time at their home. Many of us traveled to Europe with he and his wife. I hope the allegations are not true… I feel awful for his family. You never imagine something like this will happen in your community, let alone to one of the most influential people of your teenage years.

I, for one, am not surprised. It’s been a few years since I graduated, but I was in his Wind Ensemble for 4 years, and we always made jokes about how strangely he acted towards certain girls. That’s not to say I don’t hope it isn’t true, and I will never be less grateful for what he did for me when I was in his class. If it is true, he will have to pay. That is unacceptable.

I’m dismayed that the man who oversaw my transition from late childhood to adulthood and was responsible for my musical formation could do something like this. I know that recent events have taught us that everyone’s a suspect until proven innocent, but gosh. Mr. Eve was an incredibly eloquent person. The text of the notes just isn’t… him. Either he was set up, or it’s something pathological.

I was in the program when he was allegedly pulling this kind of crap. I truly hope he is found innocent, but in the event he isn’t well, that just makes me extremely sad.

I’m still in total shock. He was my teacher when I was in High School, and a good one at that.

Doesn”t say much for Rich Semler the head honcho.If he spent more time taking care of his schools and less sticking his nose up the political chains you know what, maybe things like this wouldn’t happen.
