Patrick Edward Colon, 29, a former baseball coach at Schulenburg High School in Schulenburg, Texas has pleaded guilty to two counts of improper relations between an educator and a student.

Colon was indicted on two counts of improper relations between an educator and a student and one count of sexual assault of a child in November, 2007.. The latter charge was due to the age of one of the alleged victims.

Following his guilty plea, Colon’s, who has been free on $30,000 bail since November, was being held in the Fayette County Jail awaiting transfer to state prison.

As part of the plea agreement with prosecutors, Colon has permanently surrendered his teaching certificate and has agreed to have no contact with the victims. This is return for the prosecution dropping the sexual assault of a child count.

Geoffrey S. Hulburt, 32, a former English teacher at Waverly Middle School in Waverly, New York has pleaded guilty in federal court to charges of possessing child pornography.

Hulbert admitted that he possessed more than 600 images of child pornography on his home computer, according to the Assistant U.S. Attorney handling the case.

Hulburt came to the attention of federal authorities as the result of a state investigation into allegations that Hulburt had attempted to arrange a meeting with a 16-year-old student for sexual purposes. Hulburt pleaded guilty to a charge of endangering the welfare of a child in that case.

During the course of that investigation authorities discovered pornographic images and videos of juveniles appearing to be under the age of 18 on Hulburt’s computer.

Federal authorities say that Hulburt received the child pornography over the Internet and that some of the images “depicted prepubescent minors or minors under 12 years old some portrayed in sadistic or masochistic conduct.

Hulburt faces up to 10 years in federal prison at sentencing on May 16th.

06/24/08 – Sentencing

Geoffrey Hulburt has been sentenced to six and a half years in federal prison to be followed by eight years of supervised release.

According to the U.S. Attorney’s Office, some of the images found of Hulburt’s computer depicted prepubescent minors or minors younger than 12 years old, and they portrayed sadistic or masochistic conduct or other depictions of violence.

David M. Suino, 47, a fifth-grade teacher at Tainter Elementary School, in Rice Lake, Wisconsin was charged Tuesday with one count of misdemeanor disorderly conduct, after being arrested and booked the day before on allegations of improperly touching a 10-year-old male student.

Three school employees told police they had seen Suino touching the boy in a manner that witnesses considered “wrong”.

Reportedly one school employee saw Suino holding the boy’s hands, hugging the child, rubbing the student’s hands and the 10-year-old’s bare stomach. Another employee reportedly saw Suino and the same student in the back of Suino’s classroom and that the teacher and the boy were squatting next to each other, and Suino was rubbing the boy’s back both on top of, and then underneath, the child’s shirt.

This same witness said that Suino then put his hand between the child’s legs, but she couldn’t see where it went exactly. The aide also reported that about one week before that incident, she saw the fifth-grade teacher standing close behind the 10-year-old at the blackboard where Suino had one arm on the blackboard and the other on the boy’s back.

A third witness said that that he witnessed Suino with his hand up from the knee area underneath the boy’s shorts.

The boy acknowledged the touching to police but said he does not consider it “bad touching” and indicates that Suino has never touched his privates.

If convicted Suino faces a maximum of 90 days in jail and a $1,000 fine.

06/24/08 – Plea Deal and Charges Dismissed

In a normal “plea deal” the accused either pleads “no contest” or “guilty” to some charge(s) in exchange for a lighter sentence, other charges being dropped and so forth.

That is not the case for David M. Suino whose plea deal resulted in the dropping of all charges against him in exchange for Suino agreeing to resign his teaching position with the Rice Lake school district and surrender his state teaching license.

Webmaster’s note:

The surrender of David Suino’s Wisconsin teaching license does not preclude him from seeking a teacher’s license in another state. Since all charges against him were dropped he has no criminal record as a result of this case and obviously no requirement to register as a sex offender.
